When the state legislature begins a new session on Jan. 5, the 45th Senate District seat will remain empty.
Incumbent Democrat Jim Brewster won more votes in November, thanks to mail-in ballots that voters sent in time but without writing a date on the outer envelope.
But challenger Nicole Ziccarelli says those votes shouldn’t count, and Jake Corman, the Senate’s top Republican, says neither candidate will be sworn in until Senators can review a complaint she filed with the chamber Friday.
“Our goal is to get it right, not get it fast,” Corman says.
Senate Democratic leader Jay Costa condemned Ziccarelli’s move.
“This is all part and parcel, a continuation of playing out of the Trump playbook,” Costa says.
Ziccarelli has lost a handful of legal fights but has a case pending in federal court.
